India’s new surrogacy regime discriminates on the basis of gender and marital status, according to a new public interest petition.
Although designed to prevent commercial surrogacy’s exploitation of poor and vulnerable women, the 2021 law allows only heterosexual married, divorced or widowed women to pursue non-transactional surrogacy through familial networks, leaving queer people with few legal pathways to parenthood.
